We are Fitdrop Technologies (“Company,” “we,” “us,” “our“), a company registered in Hamilton, Ontario Canada. We operate the mobile application Fitdrop (the “App“), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms“) (collectively, the “Services“).

These Terms of Service ("Terms") govern your use of the Fitdrop platform, so please read them carefully before using our services. By accessing or using the Fitdrop app, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the Fitdrop app, you agree to abide by these Terms, including any updates or changes that may be made from time to time. If you do not agree with any part of these Terms, you must discontinue your use of the app.

2. Eligibility

You must be at least 13 years of age to use the Fitdrop app. If you are under 18, you must obtain parental or legal guardian consent before using the app. By using the app, you confirm that you meet these age and consent requirements.

3. User Content

Fitdrop allows you to post images and information about your outfits ("User Content"). By posting User Content, you grant Fitdrop a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display your User Content in connection with the app's services. Additionally, by posting user content with public visibility made by a non-private account you grant Fitdrop the same rights as mentioned, and additionally the right to utilize your User Content for marketing and other business related purposes. You are solely responsible for your User Content and must ensure that it complies with these Terms and all applicable laws.

To ensure a positive and respectful environment, you agree to adhere to Fitdrop's community guidelines.

5. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

6. Account Security

You are responsible for maintaining the security of your account. Do not share your login credentials with others. If you suspect unauthorized access to your account, contact us immediately. We will never ask for your account information in any capacity, other than your username.

7. Termination

Fitdrop reserves the right to terminate or suspend your account at its discretion, without notice, if you violate these Terms or engage in inappropriate conduct on the app.

8. Disclaimers and Limitation of Liability

Fitdrop provides the app on an "as-is" basis. We do not guarantee that the app will be error-free, uninterrupted, or free from viruses. You use the app at your own risk. Fitdrop shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the app.

9. Changes to Terms

Fitdrop may update or modify these Terms at any time. We will notify users of significant changes. Your continued use of the app after such changes constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the province of Ontario, Canada, without regard to its conflict of law principles.

11. Supporter Membership Plans and Billing

Fitdrop offers a renewable "Supporter Membership" plan, which provides additional features and benefits. This plan is available on a monthly or yearly basis.

Monthly Subscription: Billed once every month on the date of purchase.

Yearly Subscription: Billed once every year on the date of purchase.

Billing Payment Information: By providing your payment information, you authorize us to charge the applicable fees for the Supporter Membership.

Auto-Renewal: Subscriptions automatically renew unless canceled before the renewal date.

You can manage or cancel your subscription through your account settings.

Pricing Changes: We may change our subscription fees; any changes will apply only to new subscriptions or renewals.

Refund Policy: All payments are non-refundable, except as required by applicable law or in exceptional circumstances at our sole discretion.

If you cancel your subscription, you will continue to have access to the Supporter Membership benefits until the end of your current billing period.

We accept the following forms of payment:

iOS App Store and Google Play Store

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services.

You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in US dollars.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. If your order is subject to recurring charges, then you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order.

We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Services.

We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
